Infosys' Non-Compete Clause
The clause restricts an employee from accepting any employment letter from a named competitor of Infosys such as TCS, Accenture, Cognizant, IBM and Wipro for a period of 6 months after leaving their jobs in Infosys.
An employee shall not accept for six months an employment offer from "named competitors" such as TCS, Wipro and HCL Technologies, among others if the new job involves working with a client with whom the employee has worked in the preceding 12 months during his stint at Infosys."
As per law
1) Employees can resign and join any competitors. i.e. employee from Infosys can join Wipro or vice versa. Company cannot restrain the employees from joining the competitors.
2) Under section 27 of the Indian Contract Act any Agreement in restraint of trade is void.
